If you're not happy with a WCB decision, no matter which stage of the process, talk to me to find out what, if anything, can be done.
When you received a decision with which you don't agree, you were probably outraged and confused. Outraged because you believe you're entitled to compensation. Confused because you didn't expect a decision to be what it is.

Every WCB case in BC is different.
The key to successfully appealing a WCB decision you don't agree with is to give WorkSafeBC lots of good evidence of your injury and how it happened at work.
Strong facts – along with support from your doctor – greatly improve your chances for a successful WCB appeal.
Getting hurt on the job is tough and painful. To then have your WCB claim denied puts you into a tough financial situation. Because of this you may not get the treatment you need to get better. This may seem unfair and can put incredible hardship on you and your family. That’s why it’s important that you don’t give up just because you’ve been denied. The WCB process offers 2 levels of appeals for most issues – use them.
This is where I may be able to help you. I'm an experienced personal injury lawyer who does WCB appeals. I know how and where to get the facts and how to present them persuasively to WorkSafeBC.
There are generally two appeal levels when your BC work injury claim is denied. The first appeal goes to a Review Board within WorkSafeBC. If your claim is still denied, you can appeal to the Workers Compensation Appeal Tribunal (WCAT). The WCAT is an organization separate from WorkSafeBC. Note, you cannot appeal tot he WCAT issues regarding Vocational Rehabilitation.
Not only do you generally have two appeal opportunities, but in some circumstances you can have your appeal to the WCAT (2nd appeal) be heard like a trial. This means you can bring witnesses and tell the WCAT yourself all about your workplace injury.
Filing your WCB appeal is done by filing written submissions to first the Review Board at WorkSafeBC. If your claim is denied, written submissions are then filed to the WCAT.
I will speak with you at length about your job, how you got hurt, and to other people who can help you by telling me what they know. These other people could be family members and co-workers. The more information about your injury and workplace that supports your workplace injury, the better chance you have in successfully appealing your WCB claim.
Call me toll free today at 1.855-854-2086 to book an initial visit to discuss your WCB/WorkSafeBC claim with me. I charge only $95 for your first 1/2 hour visit during which time you can see if you have a claim or just to get some legal advice about what your options are. I look forward to hearing from you and meeting you.
The starting point is scheduling a consultation with me.
I get many calls every day. I wish I could offer free consultations for everyone, but I simply can't. If you would like to explore your WCB options or simply would like some direction with your BC WCB matter, you can schedule a consultation with me which costs $95 plus taxes per half hour.
During your consultation, I do my best to inform you about your options, provide a quote for hiring me and/or give you direction so you can pursue your WCB matter on your own. In some cases, I may need to do additional research and/or review documents in order to give you direction and opinions. If that's the case I'll let you know. That said, I'm usually able to provide direction from a single consultation.
Anywhere in BC
I offer telephone consultations if getting to my office isn't possible.
Reviewing Documents Before a Consultation
I'm also happy to review documents such as WorkSafeBC decisions before a consultation. However, I charge a consultation fee to do this. For complex cases, this gives me an opportunity to better inform you of your options once we do have the consultation.
If you would like to schedule a consultation, just fill in the Contact form (the white one) to the right or call me toll free at 1.855.854-2086-4793.
The following is to give you an idea of my legal fee structure if, after a consultation, you wish to hire me.
a. Hourly Fee
My usual legal fee is charged hourly. You can ask me to help with some or all of your WCB matter. It's up to you.
b. Contingency Fee
In some cases I'll take your case on a contingency fee basis. This means my fee is a percentage of money you obtain from my involvement. In other cases, I may do a combination of a reduced hourly fee and reduced contingency fee.
c. Flat Rate Fee
One final fee arrangement may be a flat fee. Again, the amount and whether I offer this option is case-specific.
Please note that I reserve the right to choose the legal fee arrangement. I determine fees on a case-by-case basis.
No matter where you live, I can help with your case as long as it's a British Columbia WCB matter. I can work with WCB clients via telephone consultations and email. Don't let distance stop you from talking to me.
I'm able to provide a decent amount of direction with just one half-hour consultation. If hiring me for your entire matter is not possible, hire me on a per-consult basis charged by the half hour ($95 per half hour). I know the issues and can often give you great advice with your claim over a half hour consultation. It helps me to help you if you bring in the decisions you're appealing.
I welcome multiple consultations as you prepare and pursue your claim. Note, however, that the per-consult basis does not mean you've hired me.
For people who can't hire me, but are prepared to do their own claim and wish to get some blueprints and written direction for filing and appealing WCB claims - there's a BC Workers' Compensation Legal Kit. Click here to learn more about how this kit can help with your WCB matter.
