Introducing the BC Workers’ Compensation Legal Kit

WCB Worker's Appeal KitIf you’ve browsed around this site, you have an idea about the WCB claim and appeal services I provide.  Yet, I understand many injured workers in BC can’t hire a lawyer for a number of reasons – usually due to financial constraints.  After all, if you’re claim is denied or your disability decision was not what you expected, you’re likely going without a pay check.  That’s tough … really tough.

Fortunately WorkSafeBC offers some decent information on its website about making a claim and appealing a denied decision.  However, one area lacking any information for injured BC workers is information on how, where, and what kind of evidence to get to build a great WCB claim or appeal.

One of my central approaches when working with clients is getting great evidence to support the my clients’ cases.  Evidence supports facts which persuade outcomes.  Of course not all cases can be won … I know that.  However, many denied decisions are overturned on appeal.

What if you can’t hire me and yet you would like to build a strong claim or appeal?

There’s the BC Workers’ Compensation Legal Kit for people who need some guidance in putting together an evidence-based appeal.  Please note this Kit is designed for WCB in British Columbia.  That said, the evidence-building ideas are sound for many kinds of cases – anyone is welcome to get it.

The BC Workers’ Compensation Legal Kit has over 100 pages of information on many aspects of the WCB in BC claim and appeal process – from filing a claim to attending an oral hearing at the WCAT – and all stages in between.  It covers claim issues such as causation (i.e. were you hurt at work?), disability pensions, occupational disease, vocational rehabilitation, and more.  Note, it does not contain information for surviving spouses (i.e. fatality claims).

You get step-by-step guidelines for filling out the key WCB appeal forms (for WCB in British Columbia).  But the bulk of the Kit is about getting great evidence – the where, what, and how.

The Kit doesn’t go into too much detail about the law and policy because the WorkSafeBC website does a pretty good job covering those items.

Who is the Kit for?

The BC Workers’ Compensation Legal Kit has information for you if you are:

  • filing an initial WCB claim  OR
  • dealing with a denied claim by WCB  OR
  • were awarded (in your view) too low of a disability award  OR
  • not receiving adequate vocational rehabilitation  OR
  • appealing to the WCAT  OR
  • just have questions about your WorkSafeBC claim.
