1st WCB appeal is to the Review Division

If you’re not happy with the first decision by WorkSafeBC, you have two opportunities to appeal.

The first appeal is to the Review Division, which is part of WorkSafeBC.

When you put together your appeal, you need to think about how you’re going to persuade a decision maker with WorkSafeBC to overturn a decision made in the same organization.  Typically, the way to do this is to present very persuasive evidence that shows the first decision is wrong.  You need to build your WorkSafeBC appeal to the Review Division in such a way as the decision maker has no choice but to decide in your favour.

Fortunately you have 90 days from the date of the decision until you must start the appeal process.  Use this time to get legal help.  If you intend to appeal, don’t wait and do nothing.

This first appeal process requires that you both request a review and then actually submit the appeal.  The 90 day deadline applies to requesting an appeal.  If your appeal is granted, then you have 30 days to submit your complete WorkSafeBC appeal materials.

Because it’s a two-step process, you need to think about how you’ll proceed.  If you request a review immediately after you get the decision, then you will trigger the 30 day countdown until you must actually file your entire appeal.  This is okay to do if you have a strong appeal already put together.  However, if you need time to build your Review Division appeal, then you need to wait before requesting a review.

The fact is appealing to the Review Division can be a difficult process, especially if you want to build a strong evidence-based case.
